for 'men in basket'.

A 65-ton capacity rough terrain crane which was manufactured and sold with a load moment indicator (that would notify the crane's operator if the crane was at a point where it exceeded its weight capacity and was overloaded) had been intentionally disconnected. On the day in question, our clients who were being transported in a 'man-basket' were injured when the crane and its load overturned.

Our firm successfully argued that the contractor in charge of the jobsite was responsible for the accident since its crane operator violated safe practice standards by bypassing the load moment indicator and the contractor's improper use of the 'man-basket' which was found not to be in compliance with industry standards.

Mark D. Apelian
