$375,000 Settlement
for a scooter accident.

While receiving instructions on the safe operation of a Moped (motor scooter) for rental, our client fractured her leg when she lost control of the Moped during its operation. Our firm brought suit against the Moped rental company claiming that our client received insufficient instructions from the employee in charge leading to her injuries.

This case was later dismissed by a Superior Court judge. The judge claimed that our client had signed a waiver and that the owners of the rental company were not liable to our client since the type of injury she sustained was foreseeable and could happen absent of any negligence on the part of the rental company. The judge further ruled that our client had assumed the risk and thus could not prevail.

Our law firm appealed the judges ruling citing our disagreement with the judges findings and argued that the waiver our client signed was not worth the paper it was printed on. Fortunately, the Court of Appeals agreed with the arguments presented by our firm, and vacated the Superior Court judge's earlier ruling to dismiss it.

Although the rental company's insurance policy had been canceled , and was on the verge of filing for bankruptcy, we were nevertheless able to collect $375,000 for our well-deserving client.
