The universal negligence standard

California courts use the legal negligence standard to determine culpability in auto accident cases. This means that there must be:

  • Duty Every motor vehicle operator owes a duty to other drivers, passengers and pedestrians to drive in a reasonably safe manner. Drivers of commercial carriers, such as busses and trains, owe a heightened duty of vigilance to the public because they transport people for a fee and their vehicles can cause much more serious harm than a passenger car.
  • Breach If a driver drives below the legal standard, he or she breaches the duty. Drivers breach their duty when driving while intoxicated, speeding or swerving between lanes.
  • Causation Courts require substantial evidence that a driver’s breach actually caused the accident to find liability.
  • Damages The negligence standard requires proof of damage or harm to the accident victim.

Distracted driving is generally a breach of the duty to drive reasonably. Taking one’s hands off the wheel or taking one’s eyes off the road for any reason may constitute distracted driving. At Bryman & Apelian, our attorneys gather all the evidence, witness testimony and expert opinions necessary to establish negligence, and we tell you whether we think you have a solid case.
