Who can file a wrongful death claim in California

Even if you were extraordinarily close with the person who passed away, only certain survivors or partners are allowed to file wrongful death claims. Spouses, children and dependent parents and life partners are the primary parties who may file wrongful death claims. If the individual who passed away was not married and did not have any children, then the right to file a wrongful death suit goes to nondependent parents, siblings, nieces and nephews, grandparents, and finally blood or adopted relatives in the family line. Life partners now have rights, too.

Putative spouses, the children of putative spouses, life partners, stepchildren and minors who were dependent upon the deceased can also file a wrongful death lawsuit under certain conditions.
